1. Who we are

RoostBook is provided by Undead Fish Studio, the trading name of Content by Chris Mansfeldt, a sole proprietorship (enkeltpersonforetak) registered in Norway with organisation number 925 499 374 and owned by Christian Mansfeldt (“we”, “us”, “our”). Address: Steenstrups gate 3, 0554 Oslo, Norway. Email: hello@roostbook.app. Email is the quickest way to reach us, and we answer within 3 working days.

“The Service” means the RoostBook app on Android and in a browser at roostbook.app/app, the pages a shared link opens, this website, and the emails, notifications and home-screen widget they produce. “You” means the person using the Service and, where section 23 applies, the business you act for. Joining the iPhone list creates no account and commits you to nothing.

2. These terms, and how you agree to them

2.1 These terms are a contract between you and us. You agree to them when you confirm that you do, in the app or on this website: by ticking the box when you create an account, by ticking it on the terms sheet the app shows you, or by buying Pro. If you do not agree, do not use the Service.

2.2 We record which version you agreed to and when. The version and its date are at the top of this page. You can save or print this page at any time, and we will send you any earlier version you agreed to if you ask.

2.3 Our privacy notice explains how we handle personal data. It is there for your information and does not form part of this contract, and nothing in these terms reduces your rights under data protection law.

2.4 Other companies’ terms also apply when you use their services through ours: Google Play’s terms when you buy Pro.

2.5 These terms are written in English. If we give you a translation and the two differ, the English version applies, unless the law of the country you live in says otherwise.

2.6 These are RoostBook’s terms. If you also use another app of ours with the same account, that app has its own terms, and agreeing to one is not agreeing to the other.

3. Who can use RoostBook

3.1 You must be at least 18 and able to enter into a binding contract to create an account or buy Pro.

3.2 You may not use the Service where the law of the country you are in, or sanctions that apply to you or to us, forbid it.

3.3 An account is for one person. If you create or use one for a business, such as a farm, a smallholding that sells eggs, or a breeder, you confirm you are allowed to accept these terms for it, and section 23 applies.

4. What RoostBook is, and what it is not

4.1 RoostBook is a tool for keeping records about your birds and for reminding you of what you, and the people you share with, have entered. What it shows is what someone typed, uploaded or ticked, and dates worked out from what was entered, from intervals you chose, or from a default you can change.

4.2 It is not veterinary advice. Nothing in the Service is veterinary, medical, nutritional, legal, tax or financial advice. The Service is not a medical device and is not intended to diagnose, treat, cure, prevent or monitor any disease or condition in a bird or a person. If a bird is ill, injured or in distress, contact a vet. If you suspect a notifiable disease such as avian influenza, report it to the authority where you live straight away, and do not wait for anything in the app.

4.3 Medicine and withdrawal periods. The Service records what someone entered about a medicine. It never decides or checks a dose, a frequency, a route, a course length, an interaction, or whether a medicine is suitable or permitted for a bird, or for a bird whose eggs or meat will be eaten. It never supplies a withdrawal period. The period it counts from is the one someone copied off the medicine’s label or was given by a vet; if none was entered, the app shows no date. A date the app works out is arithmetic on the dates and the period entered, and is only as right as they are. Follow the prescribing vet’s instructions and the product’s label.

4.4 Eggs and meat are your responsibility. You alone decide whether eggs or meat from your birds are safe to eat, give away or sell. That includes keeping to withdrawal periods, storage, hygiene and any rules on selling eggs or poultry. A date in the app that says eggs are outside a withdrawal period is not a statement that they are safe, and the egg-sales record is not a statement that a sale was lawful.

4.5 Due dates, reminders and notifications. A due date, a point of lay, a moult window or a hatch day is an estimate counted from an entry, a breed and an interval. It is not a schedule recommended by a vet or an authority. Notifications and the widget can be late, blocked or never appear, because of phone settings, battery saving, the operating system or a fault on our side. Do not rely on them as your only way of remembering anything, least of all a medicine or a withdrawal.

4.6 Rules that apply to you. You are responsible for meeting the rules of any authority, landlord or insurer that apply to you and your birds. That includes registering a flock where the law requires it, housing and other measures ordered during an outbreak of avian influenza, reporting notifiable diseases, and any legal duty to keep medicine or treatment records. Documents the Service produces, such as the export and the medicine book, contain what was entered. We do not promise that any vet, official or buyer will accept them, or that they meet any legal or formal requirement.

4.7 Readings and money. Weights, egg counts, laying figures, costs, the cost of a dozen and egg sales add up what was entered. The range the app accepts for a reading is there to catch typing mistakes; it is not a normal range for any bird. None of it is accounts or tax records.

4.8 You remain responsible for the care, welfare and treatment of your birds, and for decisions made using information in the Service, including decisions made by the people you share it with.

5. Your account

5.1 Give us accurate details and keep your email address up to date. We send important notices there, including changes to these terms.

5.2 Keep your password secret and your devices locked. You are responsible for what happens on your account unless it was caused by our failure to take reasonable care. Tell us straight away if you think someone else is using it.

5.3 Entries made with no signal are kept on the device until they reach our servers. If a device is lost, reset or signed out, or the app is removed, before that happens, those entries can be lost. The app tells you how many are waiting before you sign out.

6. Your records, and the people you share them with

6.1 You decide who can see or add to your records: members of your household you add by email, and anyone you give a read-only link to.

6.2 The people you share with act for themselves and do not act for us. We do not check anyone’s identity or qualifications, including whether someone holding a link is a vet. We are not responsible for what other people enter, or for what they do with what you let them see.

6.3 What happened stays on the record. Once an egg count, a health event, a medicine, a weight, a diary entry, a cost or a sale is recorded, nobody can edit or delete it: not you, not the people you share with, and not us, except when an account is deleted as the deletion page describes. A mistake is put right by adding a correction, and the original stays on the record beside it. A bird’s own details, such as her name, and the name of a flock can be changed.

6.4 When you withdraw someone’s access, they stop seeing the record from then on. What they already saw, copied or downloaded, and what they wrote, stays.

6.5 If you put other people’s details into the Service, such as a customer’s name on an egg sale or a name in a note, you are responsible for having the right to do so and for telling them where the law requires it.

6.6 What a member of your household writes on your flock is part of your flock’s record. It stays there if you remove them or they delete their account, as the deletion page explains.

7. Shared links and guests

7.1 A shared link opens your flock read-only, without an account, until it expires within 30 days or until you withdraw it. It never shows a photograph or anything about money. Anyone who has the link can use it. Treat it like a key: send it only to the person it is for, such as a pet-sitter or a vet, and withdraw it when they are done.

7.2 If you open a flock through a shared link, you are a guest, and sections 4, 11, 17, 21 and 22 apply to you too.

8. Suggestions the app makes

8.1 The Service suggests things to save you typing: the everyday jobs a new flock starts with, how often to worm or check for mites, when a breed usually comes into lay, when a hen may moult, and the day a clutch should hatch. Each is a starting point for you to check, and none is a statement that something is right for your birds.

8.2 A breed’s facts are typical of the breed, not a description of your bird, and a drawing of a bird is drawn from her record, not from her.

9. Your content

9.1 Everything you put into the Service, including entries, photographs and notes (“your content”), stays yours.

9.2 You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display your content, only as needed to provide, secure, back up and support the Service, to show it to the people you share it with, and to comply with the law. The licence ends when your content is deleted from the Service, except for copies in backups until they expire, and for entries that stay on someone else’s flock’s record as 6.6 describes.

9.3 We do not sell your content, and we use it only as these terms and the privacy notice describe.

9.4 You confirm that you have the right to upload your content, for example that you took the photographs or have permission to use them, and that it does not break the law or anyone else’s rights.

9.5 You can take a copy of your record at any time from Settings, and ask us for a copy of your data, free, at hello@roostbook.app. Keep your own copy of anything you cannot afford to lose: we take care of your data, and the Service should still not be the only place it exists.

9.6 If you send us ideas or feedback, we may use them freely and owe you nothing for them. Please leave personal details out of them.

10. What belongs to us

The Service, its software, design and illustrations, and the RoostBook name and wordmark belong to us or to the people who license them to us. We give you a personal, non-exclusive, non-transferable licence to use the Service under these terms, for as long as they apply to you. Nothing else is licensed to you.

11. Rules for using RoostBook

You must not, and must not help anyone else to:

12. Illegal content, reports and our decisions

12.1 To report content you believe is illegal or breaks these terms, email hello@roostbook.app with where it is (a link, or a description precise enough for us to find it), why you think it is illegal or breaks these terms, your name and email address, and a statement that you believe the report is accurate and complete. We confirm that we received it.

12.2 We review reports carefully and objectively, and a person makes every decision. We do not use automated systems to decide. We may remove content or block access to it, limit features, or suspend or close an account, in proportion to what happened. We may also act on our own initiative when we find illegal content or a serious breach of these terms.

12.3 If we restrict your content or your account, we tell you what we did and why, unless the law forbids it or telling you would put someone at risk. You can reply to challenge the decision and a person will look at it again. If you are in the EU, you can also take the matter to a certified out-of-court dispute settlement body, or to court.

12.4 We may stop handling reports from someone who keeps sending reports that are clearly unfounded.

12.5 Authorities and users can contact us about these matters at hello@roostbook.app, in English or Norwegian.

13. Free and Pro

13.1 RoostBook is free to use. Pro adds the features shown on the plan screen in the app at the time you buy it. Medicine records, withdrawal dates and the full record of every bird stay available on every plan.

13.2 Pro is not on sale yet, and nothing is charged until it is. If you buy Pro, it costs $39.99 a year or $4.99 a month, or the amount Google Play shows you in your currency, including any tax it adds. The price you see before you confirm the purchase is the price you pay.

13.3 Pro is sold only in the Android app, through Google Play. Google Play takes the payment and handles billing and tax, and we never see your card details. Google Play’s terms apply to the payment.

13.4 Automatic renewal. Pro renews automatically at the end of each month or year, for the same period and at the price that applies then, until you cancel. Google Play charges you at the start of each period. You can cancel at any time in the Google Play app, under Payments & subscriptions, then Subscriptions. Cancelling stops the next renewal, and Pro stays on until the end of the period you have paid for. Deleting the app or your RoostBook account does not cancel the subscription.

13.5 Price changes. If the price of Pro goes up, we tell you at least 30 days before it applies to you, through Google Play, by email or in the app. The new price applies from your next renewal; if you do not want to pay it, cancel before then. Where Google Play or the law requires you to agree to a price rise, it does not apply to you unless you do.

13.6 Refunds. Apart from section 14 and any right the law gives you, a period you have started is not refunded. Google Play may also give refunds under its own policy. If we stop offering Pro, or close the Service, we refund the unused part of any period you have paid for.

13.7 When Pro ends, nothing is deleted. Every bird and every entry stays on the record; only the Pro features stop.

14. Changing your mind: the 14-day right to withdraw

14.1 If you are a consumer living in the European Economic Area (the EU, Norway, Iceland and Liechtenstein), the United Kingdom or Switzerland, you can withdraw from your first purchase of Pro within 14 days of the day you bought it, without giving a reason. Using Pro during those 14 days does not take this right away.

14.2 To withdraw, tell us clearly before the 14 days are up. The quickest way is Withdraw from contract here, which is also in the app under Settings, Legal. You can also email hello@roostbook.app with “withdraw” in the subject, or ask Google Play to refund the purchase. You can use the model form below, but you do not have to. We confirm by email that we received your withdrawal, with the date and time we received it.

14.3 We refund the full amount you paid for that purchase within 14 days of receiving your withdrawal, through Google Play to the payment method you used, at no cost to you. Pro then ends, and nothing on your record is deleted.

14.4 Model withdrawal form. To Undead Fish Studio (Content by Chris Mansfeldt), Steenstrups gate 3, 0554 Oslo, Norway, hello@roostbook.app: I hereby give notice that I withdraw from my contract for the supply of the following service: RoostBook Pro (monthly / yearly). Bought on: … Name: … Email address on the account: … Google Play order number, if you have it: … Date: …

15. Testing, changes to the Service, and closing it

15.1 RoostBook is new and still being tested. Features can change, be incomplete, contain mistakes or be withdrawn.

15.2 We may change, add or remove features for good reasons, such as improving the Service, security, the law, or changes made by the companies we rely on. If a change removes or materially worsens a Pro feature you have paid for, we tell you in advance, and if you are a consumer you may cancel and have the unused part of your period refunded. Changes needed for security, to fix a fault, or because the law requires them may be made straight away.

15.3 We work to keep the Service available but cannot promise it will always be available, uninterrupted or free of faults. We may take it offline for maintenance, and it depends on other companies’ systems, which can fail.

15.4 If we decide to close the Service, we tell you at least 60 days in advance by email and in the app, keep it possible to get a copy of your records during that time, and refund the unused part of any Pro period.

16. Our responsibility for the Service

16.1 Consumers in the EEA, the UK and Switzerland. We must supply the Service as these terms describe it and as the law of your country requires, with reasonable care and skill. If it does not conform, you have the remedies that law gives you, such as having it put right, a price reduction or ending the contract. Nothing in these terms limits those rights.

16.2 Everyone else, as far as the law allows. The Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted, timely, secure or free of errors, that data will never be lost, that any notification will be delivered, or that any result, including due dates, withdrawal dates and laying figures, will be accurate. We disclaim all implied warranties and conditions, including those of merchantability, fitness for a particular purpose, title and non-infringement. Some places do not allow these exclusions; where that is so, they apply only as far as allowed.

17. Limits on our liability

17.1 What we never limit. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for loss we cause intentionally or through gross negligence, under product liability law, or for anything else the law does not allow us to exclude or limit. Nothing in these terms affects your statutory rights as a consumer.

17.2 Consumers in the EEA, the UK and Switzerland. Apart from 17.1, we are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. Loss is foreseeable if it is obvious it will happen, or if both of us knew it might happen when you agreed to these terms. We are not responsible for loss that was not foreseeable, for loss caused by you or by the people you share with, or for loss caused by events outside our reasonable control. Where we are only slightly negligent, we are responsible only for breaking an obligation essential to the contract, and only up to the loss that is typical and foreseeable for a contract like this one. We supply the Service for your private use; if you use it for a business, we are not responsible for loss of profit, business, revenue or opportunity.

17.3 Everyone else, as far as the law allows. We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, revenue, goodwill, data or opportunity. We are not liable for the illness, injury, death or loss of value of any bird, for veterinary, treatment or replacement costs, for eggs or meat that had to be thrown away, withdrawn or recalled, or for fines, sanctions or other measures by an authority. We are not liable for the content or conduct of other users, guests or third parties, or for services run by other companies. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event that gave rise to the claim, and 100 US dollars or its equivalent in your currency. These limits apply whatever the legal basis of the claim, including contract, negligence, strict liability and statute, even if we were told such loss was possible, and even if a remedy fails of its essential purpose. They do not reduce anything in 17.1.

18. Your responsibility to us

18.1 If someone else brings a claim against us because you broke these terms or the law, or because your content infringes their rights, you will compensate us for the resulting losses and reasonable costs, including reasonable legal fees, to the extent you caused them. If you live in the United States, this means you will defend, indemnify and hold us harmless against such claims, to the extent you caused them.

18.2 If you are a consumer in the EEA, the UK or Switzerland, 18.1 applies only to the extent the law of your country makes you responsible for that loss.

18.3 We will tell you promptly about any such claim and let you take part in the response to it.

19. Ending your use, and when we may suspend or close an account

19.1 You can stop using the Service at any time, and delete your account as the deletion page explains. If you pay for Pro, cancel it in Google Play first.

19.2 We may suspend or close your account, or restrict features, if you seriously or repeatedly break these terms, if the law or an authority requires it, if it is necessary to protect the Service, other people or animals from harm, or if we close the Service under 15.4.

19.3 Unless it is urgent or the law forbids it, we tell you first, give you our reasons and a chance to respond, and give you a reasonable opportunity to get a copy of your records. If we close a paid account when you have not broken these terms, we refund the unused part of your Pro period.

19.4 When the contract ends, the sections that by their nature should continue, including 4, 6.3, 6.6, 9.2, 10, 16, 17, 18, 21, 22 and 24, go on applying.

20. Changes to these terms

20.1 We may change these terms for a valid reason: a change in the law or in a regulator’s guidance, a change to the Service or to the companies we rely on, security, preventing misuse, making the terms clearer, or a change in who provides the Service (24.4).

20.2 If a change could disadvantage you, we tell you by email or in the app at least 30 days before it takes effect, and the new version carries its date at the top of this page. If you do not agree, you can stop using the Service and delete your account before then. If you pay for Pro you can cancel, and if the change materially disadvantages you during a period you have paid for, we refund the unused part. We may ask you to accept the new version in the app before you go on using it.

20.3 Changes that do not disadvantage you, such as corrections and clarifications, apply when we publish them.

21. Law, courts and complaints

21.1 Norwegian law governs these terms and any dispute about them or the Service. If you are a consumer living in another country, you also keep the protection of the mandatory rules of that country’s law, which these terms cannot take away.

21.2 Every dispute between you and us about these terms or the Service is decided by the courts of Norway, with Oslo District Court (Oslo tingrett) as the court of first instance, wherever you live. There is no arbitration. The one exception is one the law gives consumers and these terms cannot remove: if you are a consumer living in the EEA, the UK or Switzerland, you may also bring proceedings in the courts of the country you live in, and we can bring proceedings against you only there.

21.3 Please tell us first. Write to hello@roostbook.app with what went wrong and what you would like us to do; most problems are solved quickly that way.

21.4 If you live in Norway, you can also ask Forbrukerrådet (the Norwegian Consumer Council) to mediate, and the case can then go to Forbrukerklageutvalget. If you live elsewhere in Europe, the European Consumer Centre in your country can help with a cross-border complaint.

22. Individual claims only

22.1 Before you start a court case, write to us at hello@roostbook.app with your name, the email address on your account, what the dispute is about and what you want, and give us 60 days to try to settle it. We will do the same before we start one against you.

22.2 As far as the law that applies to you allows, you and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding, and you and we waive any right to a jury trial. This does not apply to a consumer in the EEA, the UK or Switzerland, whose right to be represented in a collective action the law protects.

23. Using RoostBook for a business

If you use the Service for a business, or accept these terms for one, you are not a consumer. So: the parts that apply only to consumers (section 14, 16.1, 17.2 and 18.2) do not apply to you; 16.2, 17.3 and 18.1 apply to you in full; Norwegian law governs without the exception in 21.1; Oslo District Court has exclusive jurisdiction; and any claim against us must be brought within one year of the date you knew, or should have known, about it.

24. General

24.1 These terms, together with what the app shows you when you buy Pro, are the whole agreement between you and us about the Service.

24.2 If a court finds part of these terms invalid or unenforceable, the rest stays in force.

24.3 If we do not enforce a right straight away, we can still enforce it later.

24.4 We may transfer this contract to a company we control, for example a limited company that takes over RoostBook, or to anyone who takes over the Service, as long as your rights under these terms are not reduced. We will tell you, and you can close your account if you object. You may not transfer your account or this contract without our agreement.

24.5 We are not responsible for a delay or failure caused by events outside our reasonable control, such as a failure of a hosting provider, an app store, the internet or the power supply, an attack, or a natural disaster. We will tell you and do what we reasonably can to limit the effect.

24.6 We send notices to the email address on your account or in the app, and you send them to hello@roostbook.app. A notice by email counts as written.

24.7 Nobody other than you and us has rights under these terms, except where the law gives them. “Including” means “including without limitation”.
